PURCHASE POLICY

We operate on a first-come, first-served basis. Any attempts to purchase outside of the scheduled drop time, including but not limited to the use of bots, scripts, or other automated methods, will be canceled.
1- ORIGINALS
1.1- High-Value Transactions & Reservation Deposits

For any original artwork with a purchase price exceeding EUR€50,000 (fifty thousand euros), the following terms apply:

  • The Reservation Deposit: To secure the artwork, the Buyer must complete a non-refundable "Reservation Deposit" (as specified on the product page - EUR50,000 (fifty thousand euros)) via the website checkout. This deposit serves as a formal commitment to purchase and removes the artwork from public sale.

  • Balance of Payment: The remaining balance of the total purchase price must be paid via Bank Wire Transfer within forty-eight (48) hours of the deposit confirmation.

  • Forfeiture & Cancellation: If the artist does not receive a wire confirmation or proof of initiation within the 48-hour window, the artist reserves the right to cancel the transaction. In such an event, the Reservation Deposit will be retained as a liquidated damages fee to cover the loss of opportunity and administrative costs, and the artwork will be offered to the next collector in the priority queue.

  • Identity Verification: For transactions over EUR50,000, the Buyer may be required to provide government-issued identification or "Know Your Customer" (KYC) documentation prior to the finalisation of the Bill of Sale to comply with international art market regulations.

1.2- Contract Execution

All purchases of original artwork made through this website are subject to the execution of a separate written contract of sale between the artist and the purchaser, and these terms form part of and reflect the ownership and intellectual property provisions of that contract.

Ownership of any original artwork transfers to the buyer only upon full payment. Ownership is strictly limited to the physical artwork.

All intellectual property rights, including copyright, moral rights, reproduction, licensing, and derivative rights, remain exclusively with the artist. The buyer may not reproduce, distribute, publish, license, or commercially photograph the artwork, or create derivative works, without the artist’s prior written consent.

Risk of loss or damage passes to the buyer once the artwork leaves the artist’s possession. Insurance following dispatch is the buyer’s responsibility.

The artwork may not be sold, transferred, consigned, auctioned, lent, or otherwise disposed of without the artist’s prior written consent. Any approved transferee must agree to be bound by these terms. Any unauthorized transfer is void.

Each artwork may be accompanied by a certificate of authenticity, which must remain with the artwork in the event of approved resale or transfer.

The buyer agrees to properly care for and preserve the artwork in accordance with professional conservation standards.

Any breach of this section constitutes a material breach of these Terms & Conditions. The artist reserves all legal and equitable remedies.

2- PRINTS

While limited edition prints do not have the raised texture of the originals, we have carefully developed precise scanning and printing methods to preserve the detail and depth of the original works in these flat reproductions. Please note that cancellations cannot be made on the basis that the prints lack texture.

Once a print is dispatched, unfortunately no changes can be made.

Our customer service team endeavours to respond to enquiries at  orders@wernerbronkhorst.com within 24-48 hours.

If your print arrives damaged, we are committed to making it right. Kindly email our team at orders@wernerbronkhorst.com with photos of the damage, and we will promptly send you a replacement at no additional cost.

3- EXCHANGES

As the artist intentionally manufacturers small quantities of prints and merchandise to limit overproduction, exchanges of any kind are not permitted.

4- RETURNS & REFUNDS

Original artworks and standard prints purchased online may be returned within 14 days from the date of delivery, without giving a reason, in accordance with applicable consumer withdrawal rights.

To request a return, please contact contact@floragoedefroit.com within the 14-day period, stating your name, order number, and the item concerned. The item must be returned unused, undamaged, and in its original condition and packaging.

Return shipping costs are borne by the customer, unless the item is defective, damaged, or not as described. The original purchase price and standard delivery costs will be refunded within 14 days after the return request, provided the item has been received back or proof of return shipment has been provided.

Commissioned artworks, personalised pieces, custom-made works, custom sizes, and custom-framed works are created specifically for the customer. These items are final sale and cannot be cancelled, returned, or refunded for change of mind once the order has been confirmed.

This does not affect your statutory rights if an item is damaged, defective, or not as described.
